Trans-Person’s Early Pension Ruling Prompts Calls for Legal Reform

Fidesz deputy parliamentary group leader Gabriella Selmeczi reacted in the Magyar Nemzet newspaper to a court’s decision that a transgender woman can also benefit from the “Women 40” reduced pension. In her view, after the court ruling, it was necessary to amend the relevant law. She also said that it was outrageous that there was a judge in Hungary who could make such a ruling.

“The case is a gross provocation and a slap in the face of the legal system. It is outrageous that the ‘Women 40’ preferential pension options are being mocked,” Gabriella Selmeczi, deputy leader of Fidesz, told Magyar Nemzet, reacting to the decision of the Veszprém Court of Justice that transgender people can also benefit from the early retirement pension reserved for women. The government politician recalled that in 2010, it was Prime Minister Viktor Orbán who proposed to the Fidesz-KDNP parliamentary group that

women should be honored and respected by allowing those who have worked 40 years, including time spent raising children, to retire.

She stressed that parliament had supported the proposal and that since then, an increasing number of women have taken advantage of the “Women 40” every year, many of them grandparents. Gabriella Selmeczi pointed out that there was full agreement in Hungarian politics that women should be honored with the possibility of a reduced pension.

The Fidesz-KDNP parliamentary grouping still maintains that there are only biological sexes. It is outrageous that there is a judge in Hungary who can make such a judgement,”

the Fidesz politician argued.

She pointed out that the case should not go unnoticed by lawmakers, and therefore an amendment to the law is necessary. Selmeczi hopes that Fidesz-KDNP will review the laws and amend them if need be.

“I am not alone in the group with my opinion that an amendment to the law should be submitted as soon as possible to make it clear that we honor women with the “Women 40″ opportunity, and so that no sensitized judge be in a position to make a decision as such in the future,” she said. As for the fact that the case was taken up by the Háttér Society, an organization supported by George Soros, the deputy group leader said that this is further proof of what Soros organizations are paid to do, and of the kind of work they have to do.

They are provoking Hungarian society and the will of the legislature to honor women with the possibility of a preferential pension. As a woman, I resent it when someone provocatively abuses the opportunities offered by the legislation,”

she noted.

It is noted that the Háttér Society (HS) reported on its website that the main protagonist of the case, who was born male, has had a female gender and female name on her birth certificate, identity card, and social security card since 2013. So, as the HS writes, they were “quite surprised” when it turned out in 2021, that the pension payer still had him registered as a man, so they were not subject to the rules on the reduced pension for women after 40 years of service. The transgender person challenged the decision in court, with the help of the Háttér Society, and the court ruled that the government agency had unlawfully narrowed the statutory definition of “sex” to sex at birth.
