The government is tightening up the advertising law, Economx spotted in the latest Hungarian Gazette. Under the amendment, it will no longer be possible to advertise alcoholic beverages in the vicinity of health and educational institutions. Retailers will also have to pay attention to the changes, as the ban also applies to display windows.
The portal points out that “advertising that may harm the physical, mental, emotional, or moral development of children and minors” was already prohibited. In addition, it is currently prohibited “to make advertising available to children under eighteen years of age that depicts sexuality for its own sake or promotes or displays a deviation from the identity of the sex of birth, gender reassignment, or homosexuality.”
A new point has been added to the paragraph detailing these provisions:
Advertising to children or minors that presents products or their use or enjoyment in a way that is harmful or dangerous to life, health or physical integrity is prohibited.”
The second paragraph of Article 18 on the basic conditions and certain restrictions of commercial advertising has also been changed.
“It is prohibited to publish an advertisement for alcoholic beverages
(a) on the outside of the front cover of a press product or, in the case of a website, on the opening page,
(b) in a theatre or cinema before 8 p.m.
(c) immediately before, during, and immediately after a program for children or minors
(d) on products and their packaging clearly intended for play; or
(e) in a public educational or health establishment and within 200 meters of any entrance to such an establishment, on outdoor advertising material, in a store window, or otherwise visible from the public highway or in a public place.”
What is new here is the last point. Under the previous law, the prohibition applied to outdoor advertising in public education and health establishments and within 200 meters from the entrance to such establishments, but now it is no longer possible to display advertising for alcoholic beverages in store windows or in areas visible from public places.
The law will enter into force on January 1, 2025.
